2. Applicability
These general terms and conditions apply to every offer from Odette’s Jewellery and to every Agreement concluded between Odette’s Jewellery and the consumer. By placing an order or accepting a quote, the consumer agrees to these terms and conditions.

3. Offer and Agreement
1. The offer contains a complete and accurate description of the products offered. Photos and
images are as accurate as possible, but may differ in color or detail from the final product.
2. An agreement is concluded when the consumer places an order or accepts a quote
in writing or electronically.

4. Execution of the Agreement
1. Custom-made products are manufactured to the best of Odette’s
Jewellery’s knowledge, craftsmanship, and style. No guarantee is given that the result will fully correspond to the customer’s image or
expectations.
2. Odette’s Jewellery reserves the right, if necessary, to engage third parties to execute (part of) the agreement. 3. Deviations in color, shape, or size resulting from the artisanal process do not constitute grounds for rejection, cancellation, or compensation.

5. Information provided by the consumer
1. The consumer is responsible for correctly and timely providing all information necessary for the execution of the agreement, including name, address, and shipping information.
2. If the consumer provides incorrect or incomplete information, or does not provide information on time,
resulting in the agreement not being executed or not being executed in full or causing a delay, the resulting additional costs and damages will be borne entirely by the consumer.

6. Prices and Payment
1. All prices exclude shipping costs, unless stated otherwise.
2. Payment is made via the payment methods offered in the webshop.
3. Odette’s Jewellery reserves the right to change prices, with the exception of agreements already concluded.
4. The consumer is legally in default if they fail to meet payment obligations within the specified payment term. From the moment of default until the invoice is paid in full, the consumer owes statutory interest.
5. If the consumer is in default or in breach of contract, all reasonable costs incurred by Odette’s Jewellery to collect the claim will be borne by the consumer.
6. If the consumer is in a state of liquidation, bankruptcy, or suspension of payments, all claims of Odette’s Jewellery against the consumer are immediately due and payable.

7. Delivery and Shipping Policy
1. General – Odette’s Jewellery ships worldwide and strives for careful delivery. All shipments are provided with a track & trace code.
2. Production Time and Shipping
– All jewelry made to order has a production time of 4 business days, unless otherwise stated with the product.
– Once production is completed, the following shipping times apply: BENELUX 1–2 business days, Other EU 2–7 business days, Outside EU 5–21 business days (depending on location and customs).
– If a piece of jewelry is offered as ready to ship, it will be shipped within 2 business days.
3. Shipping costs per region
– BENELUX (Netherlands, Belgium, Luxembourg) – Always free shipping – Includes track & trace
– Other EU countries (Bulgaria, Cyprus, Denmark, Germany, Estonia, Finland, France, Greece, Hungary, Ireland, Italy, Croatia, Latvia, Lithuania, Malta, Austria, Poland, Portugal, Romania, Slovenia, Slovakia, Spain, Czech Republic, Sweden) – €9.95 shipping on orders up to €250 – Free shipping on orders over €250
– United Kingdom (UK) – €16.95 shipping on orders up to €300 – Free shipping on orders over €300 – Please note: Import duties or VAT may be charged by UK customs. These costs
are the responsibility of the customer.
-Switzerland, Norway, Iceland – €18.95 shipping on orders up to €300 – Free shipping on orders over €300 – Please note: Import duties, VAT, or handling fees may be charged upon receipt. These fees are the responsibility of the customer.
– United States (US) – €24.95 shipping on orders up to €350 – Free shipping on orders over €350 – Please be aware that customs may experience delays. Import duties may apply depending on the value and regulations.
– Other countries (Rest of the world) – €29.95 shipping costs for orders up to €400 – Free shipping from €400 – Please note: for deliveries outside the EU, local import duties, VAT, or administration fees may apply. These costs are the responsibility of the customer.
– Odette’s Jewellery will make every effort to ship to other countries, but cannot guarantee that shipping will be possible in all cases. Due to geopolitical or environmental circumstances,
delivery may not be possible.
4. Delivery address – Delivery will be made to the address provided by the customer when ordering. The customer is responsible for providing correct address information.
5. Transfer of risk – The risk of damage or loss passes to the customer upon
delivery. If a package cannot be delivered and is returned, additional
shipping costs may be charged for reshipment.
6. Delays – If delivery is delayed or an order cannot be fulfilled, the consumer will be notified as soon as possible.

8. Right of Withdrawal
1. The consumer has the right to cancel an order up to 14 days after receipt without giving a reason. This must be communicated by sending an email to info@odettesjewellery.nl.
Returns will not be accepted without prior notice.
2. Exclusion: The right of withdrawal does not apply to products that are custom-made or personalized. Also excluded are: discounted products, gift cards, and products purchased in person (for example, at a market).
3. If the right of withdrawal does apply, the consumer must return the product unworn, undamaged, and in its original packaging.
4. The return shipping costs are the consumer’s responsibility, and the consumer bears the risk of loss or damage to the product during return shipping. 5. Refunds will be processed once the return has been received and
assessed by Odette’s Jewellery, no later than 14 days after receipt. Refunds will be made using the same payment method used, unless otherwise agreed.

9. Warranty and Conformity
1. Odette’s Jewellery guarantees that the delivered products comply with the agreement and
the legal provisions.
2. All jewelry has a warranty period of 12 months after delivery, exclusively for
manufacturing defects.
3. The warranty does not apply to normal wear and tear, damage due to improper use or lack of maintenance, or
discoloration due to contact with water, cosmetics, or cleaning products.
4. If a product becomes defective within the warranty period due to a manufacturing defect, Odette’s
Jewellery will repair or replace the product free of charge.

10. Liability
1. Odette’s Jewellery is not liable for damage caused by improper use, failure
to follow maintenance instructions, or normal wear and tear. 2. Odette’s Jewellery is not liable for allergic reactions or skin irritations resulting from wearing jewelry.
3. Odette’s Jewellery’s liability is in all cases limited to the purchase price of the product in question.

11. Intellectual Property
1. All designs, images, photos, texts, and other content on the Odette’s Jewellery website are protected by copyright and/or trademark law.
2. It is not permitted to copy, distribute, or otherwise use any material without the written permission of Odette’s Jewellery.
3. Products created in fulfillment of an agreement may be used for portfolio purposes. If no personal data is visible, Odette’s Jewellery may include photos of the products in the portfolio, unless an objection has been raised and Odette’s Jewellery has been notified in writing in advance.

12. Promotions and Offers
1. Promotions, discounts, and offers are valid for the indicated period and/or while supplies last.
2. Additional terms and conditions may apply to promotions and offers, which are stated for each promotion.

13. Force Majeure
1. Odette’s Jewellery is not obliged to fulfill any obligation if it is prevented from doing so by a circumstance beyond its control.
2. Force majeure includes: strikes, fire, water damage, pandemics, transport disruptions, government measures, supplier delays, and other circumstances that prevent the normal execution of the agreement.

14. Complaints Procedure
1. Complaints submitted will always be answered within 10 days of receipt.
2. If a complaint requires a foreseeably longer processing time, the consumer will receive an acknowledgement of receipt within 10 days with an indication of the timeframe within which a substantive response can be expected.
3. Complaints can be submitted via info@odettesjewellery.nl.
4. Submitting a complaint does not suspend the payment obligation.

15. Dispute Resolution
1. Agreements between Odette’s Jewellery and the consumer are exclusively governed by Dutch law.
2. Disputes will be resolved by consultation as much as possible.
3. If this is not possible, the dispute will be submitted to the competent court in the jurisdiction where Odette’s Jewellery is established.
